2. Definition of additional terms used in the agreement

Website: The content available under the vaperina.cc domain is exclusively accessible to persons who have reached the age of 18 and are of legal age in the jurisdiction from which they access the website — who wish to switch from traditional cigarettes to electronic cigarettes or have already done so. The use of electronic cigarettes may cause nicotine addiction! The Operator does everything possible to ensure that the Website and its content are not appealing to children and non-smokers!
Visitor: A person who has reached the age of 18 and is of legal age in the jurisdiction from which they access the Website, who has not yet created a user account on the Website.
User: A person who has reached the age of 18 and is of legal age in the jurisdiction from which they access the Website, who has created a user account on the Website.
Member: A User who has spent enough time on the Website to reach Trust Level 2 and become a Member.
Advertiser: A Member who has posted at least one advertisement on the Website.
Mentor: A User who is one of the most active readers and most trusted contributors, helping to make our community great.

The Operator offers this Website, including all information and services available on it, to you, the User, provided that you accept the terms, conditions, rules and notices set out herein.

The Operator reserves the right to update or modify these terms at any time without prior notice. By continuing to use Vaperina following any changes, you agree to abide by the modified terms. We therefore recommend that you review these terms regularly while using this Website.

3. Operator’s liability

The Operator guarantees that the use of the Website and its services will be made available free of charge for an indefinite period.

The Operator does everything possible to ensure that the Website and its content are not appealing to children and non-smokers. The Operator explicitly prohibits the promotion or positive portrayal of products popular among children, such as Elf Bar, Poco Bar and other electronic cigarettes, to children on the Website. Various sections of the Website contain attention-drawing banners and notices that clearly state that the Website and its content are exclusively intended for persons aged 18 and over who are of legal age in the jurisdiction from which they access the Website. Furthermore, the visibility and accessibility of the Website and its content is restricted for Visitors.

The Operator further guarantees that active User accounts are regularly reviewed and that if there is reason to suspect that the account holder is under 18 years of age, the account and all stored data will be immediately removed. The structure of the Website and its associated trust levels and restrictions greatly contribute to filtering out persons under the age of 18.

The Operator guarantees that everything will be done to ensure that no illegal activity or services take place on the Website. The Report function on the Website allows Users to easily report illegal or otherwise harmful content by clicking the Report button found on posts.

The Operator assumes no responsibility and cannot be held liable for any damages or viruses arising from accessing, using, browsing or downloading any material from the Website that may infect your computer, telecommunications equipment or other property.

The Operator assumes no responsibility for the content, security, data handling practices or any damages arising from visiting third-party external links posted on the Website. To protect users, the Website may apply technical restrictions (visibility tied to trust levels) and confirmation mechanisms (warning dialog) before opening external links; however, visiting external websites is always done at the User’s own risk.

The Operator guarantees that everything possible will be done to prevent any advertisement or Advertiser associated with fraud from appearing on the Website!

The Operator draws attention to the fact that the purchase and sale of advertised products should in all cases take place during a personal meeting between Users! In addition to being the safest method of transaction, it is also the most reliable way to ensure that transactions occur only between persons aged 18 and over who are of legal age in the jurisdiction from which they browse the Website.

The Operator cannot be held liable for any damages arising during the sale of any product advertised on the Website.

The Operator cannot be held liable for any activity, contact or communication between Users that occurs outside the Website (by phone, email, Messenger or any other platform), including in-person meetings!

Furthermore, the Operator cannot be held liable regarding the actual condition and origin of any product advertised on the Website!

The Website may contain inaccuracies, errors or typographical mistakes. The Operator does not guarantee that the content will be continuous or error-free.

4. Roles

At the Operator’s discretion, certain Users on the Website may be granted greater permissions regarding content and other operations. These Users may be assigned the role of Moderator, Category Moderator or Administrator.

Moderator: A Moderator is a User who assists the Operator in enforcing the terms set out in this agreement and the provisions of the Guidelines on the Website, and provides assistance and information to users regarding questions and requests about the Website’s operation. On Vaperina, the Moderator role is currently held by @Vaperina_Kinga.

Category Moderator: A Category Moderator is a User who assists the Operator in enforcing the terms set out in this agreement and the provisions of the Guidelines within specific categories of the Website, and provides assistance and information to users regarding questions and requests about the Website’s operation. There is currently no designated Category Moderator on Vaperina.

Administrator: An Administrator is a user who assists the Operator in enforcing the terms set out in this agreement and the provisions of the Guidelines on the Website, and provides assistance and information to users regarding questions and requests about the Website’s operation. They also carry out Moderator duties and other tasks related to the Website, including development, maintenance and fixing issues. On Vaperina, the Administrator role is currently held by the Operator, @Donat.

5. Acceptable use of the Website

The User guarantees that they will not violate the law through the use of the Website.
The User acknowledges and accepts that Users who offer illegal services on the site for the purpose of generating revenue will be immediately banned.
The User acknowledges and accepts that they may not use or attempt to use another account on the Website without the explicit permission of the Operator.
The User acknowledges and accepts that they may only buy, sell or trade on the Website using their own username and unique identifier. Furthermore, the User acknowledges and accepts that they may not trade with a person under the age of 18 on the Website; if this occurs, the User’s account will be immediately suspended or removed.
The User acknowledges and accepts that they may not send advertisements, chain letters or other solicitations through the Website, nor use the Website to collect addresses or other personal data for commercial mailing lists or databases.
The User acknowledges and accepts that they may not automate access to or monitor the Website using, for example, a web crawler, browser plugin or add-on, or any other computer program that is not a web browser. However, they may crawl the Website to index it with a publicly available search engine, if they operate one.
The User acknowledges and accepts that they may not use the Website to send emails to distribution lists, newsgroups or bulk email aliases.
The User acknowledges and accepts that they may not falsely claim to be affiliated with a company or organization.
The User acknowledges and accepts that they may not link to images or other non-hypertext content located on other websites’ forums.
The User acknowledges and accepts that they may not remove proprietary markings from materials downloaded from the Website.
The User acknowledges and accepts that they may not display any part of the Website on another website using an <iframe>.
The User acknowledges and accepts that they may not block, circumvent or otherwise bypass the Website’s security or access restrictions.
The User acknowledges and accepts that they may not strain the Website’s infrastructure with an unreasonable volume of requests or with requests that impose an unreasonable burden on the information systems underlying the Website.
The User acknowledges and accepts that they may not impersonate others through the Website.
The User acknowledges and accepts that they may not encourage or assist anyone in violating these terms.

6. Content standards

The protection of children is of paramount importance, and publishing content related to the use of electronic cigarettes may make the product appealing to children.
The User acknowledges and accepts that, in order to protect children, they may not publish any content related to the use of electronic cigarettes by minors or any similar context.
The User acknowledges and accepts that it is prohibited to publish any content on the Website relating to the purchase, sale or acquisition of disposable (single-use) electronic cigarettes or nicotine-containing products.
The purpose of this prohibition is to ensure that the Website complies with applicable Hungarian legislation, to promote a responsible, long-term use-oriented community approach, and to distance itself from the promotion of illegal products or products targeting minors.
The User acknowledges and accepts that they may not publish content on the Website that is unlawful, offensive or otherwise harmful to others. This includes harassing, inappropriate or abusive content.
The User acknowledges and accepts that they may not publish content on the Website that violates the law, infringes anyone’s intellectual property rights, violates anyone’s privacy, or breaches agreements made with others.
The User acknowledges and accepts that they may not send content containing malicious computer code through the Website, such as computer viruses or spyware.
The User acknowledges and accepts that they may not use the Website to disclose information they are not authorized to publish, such as confidential or personal data of others.
Displaying the content of the Website on another website, social media platform or other platform accessible to persons under 18 is strictly prohibited, including media content, textual documentation and other intellectual property found on Vaperina, in whole or in part.

Furthermore, the unauthorized appropriation of the Website’s content and its display on another website, social media platform or other platform without prior agreement and without crediting the original author is strictly prohibited, including media content, textual documentation and other intellectual property found on Vaperina, in whole or in part. Please contact us.

7. Hate speech and hate crimes

Hate speech and hate crimes are prohibited on the Website.

Hate speech is expression that denigrates, vilifies or threatens a person based on their membership of an ethnic group, religious community, sexual minority, etc.

Hate crimes are acts that incite violence or discrimination against members of an ethnic group, religious community, sexual minority, etc.

Hate speech: Communication directed against members of an ethnic group, religious community, sexual minority, etc. that discriminates against them on the following grounds:
- Skin color
- Language
- Origin
- Nationality
- Ethnic background
- Religion
- Gender
- Sexual orientation
- Gender identity
- Disability
Hate crimes: Violent or threatening acts directed against members of an ethnic group, religious community, sexual minority, etc. on the above grounds.

Hate speech and hate crimes can have serious consequences, including:

Violence: Hate speech can lead to violence against targeted groups.
Intimidation: Hate speech can intimidate and silence targeted groups.
Discrimination: Hate speech can lead to discrimination against targeted groups.

Combating hate speech and hate crimes is everyone’s responsibility. We must all take the necessary steps to prevent such acts.

The following content is prohibited on the Website:

Racist, antisemitic, homophobic, transphobic or other discriminatory content.
Content that incites violence or hatred.
Hate-inciting, exclusionary or content aimed at the sexual exploitation of children.

Content containing hate speech or hate crimes will be removed from the Website. User accounts engaging in hate speech or hate crimes will be suspended or removed from the Website.

The Website strives to create an atmosphere of tolerance and inclusion for all Users. Users are obliged to refrain from hate speech and hate crimes.

8. Enforcement

The Operator reserves the right to change, edit and/or delete any content on the Website for any reason. If you believe that someone has submitted content to the Website that violates these terms, please contact us immediately at team@vaperina.com or contact a Team Member privately.

9. Account

To use certain features of the Website, you must create and log in to an account.

9.1 Registration

To create an account, the Visitor must provide some personal information. The Visitor acknowledges and accepts that by registering, they undertake to provide at least one valid email address and keep it up to date at all times.

Registration on the Website can be done in two ways:

Traditional registration
For traditional registration, the Visitor must provide a valid email address, to which a confirmation email will be sent upon completion of registration to verify the validity of the email address provided. In addition, the Visitor must provide an available username and a password of at least 10 characters.
Sign in with Google
An account can also be created using Google by clicking the Sign in with Google button. In this case, the verification of the Visitor’s email address is handled by Google. During Google registration, Google provides us with some information, such as the Visitor’s Google account email address, name and profile picture. This data is required to simplify the registration process and speed up account creation.

- Username (The username is automatically generated from the name in the Visitor’s Google account. It can be changed before finalizing registration, or requested later on the Website — please contact us.)
- Name (Can be changed before finalizing registration, or at any time later in the user account settings.)
- Profile picture (Can be changed at any time in the user account settings.)

The Visitor may also provide their country of residence during registration. This is currently optional, but may be introduced as a mandatory field in the future. The purpose of providing a country is to allow available content to be displayed in a relevant manner by country and to enrich the community experience. The country is displayed alongside posts, on the profile page and on the profile card.

For already registered Users, providing a country may also become mandatory in the future. The country can be set and modified at any time in the profile settings.

At the final step of registration, the Visitor must declare — by checking the relevant checkboxes — that they are 18 years of age or older and of legal age in the jurisdiction from which they are browsing the Website, and that they have read and understood the Terms of Service, Privacy Policy and Guidelines!

9.2 Login

There are several ways to log in to the Website.

Traditional login
For traditional login, the User can log in to the Website using their unique identifier set during registration. This unique identifier can be either the combination of the email address and password provided during registration, or the combination of the username and password provided during registration.
Login with link
In addition to traditional login, the User can also log in to the Website without using a password. In this case, after entering the unique identifier (email address or username), clicking the Skip password: send login link by email link will send an email to the address provided during registration containing the link required to log in, which includes the encrypted parameters needed for authentication.
Login with PassKey
PassKey allows login using the device’s biometric identifier (fingerprint, face recognition) or by entering the code used to unlock the device. By clicking the Login with PassKey button, you can log in to the Website using your device’s biometric identifier, which can be set up in the user settings. Sign in with Google
It is also possible to log in using Google by clicking the Sign in with Google button. In this case, the User’s authentication is handled by Google and no additional identifier (email address, username, password) is required to log in.

You can close your account at any time by sending a request to info@vaperina.com or by contacting a Team Member privately.

We will review the user’s public activity on the Website and if it is not significant and deleting the account would not harm the community, we will fulfill the request and remove the account from the Website.
If the User is an active member of the community with many valuable posts on the Website, this content will be transferred to a so-called anonymous user account. These accounts do nothing other than preserve posts that do not contain personal content, so that the meaning of existing conversations is maintained in most cases.

The User agrees that they are responsible for all activity attributable to their account — regardless of whether it was authorized or not — until they either close their account or notify the Operator that their account has been compromised. The User agrees to notify the Operator immediately if they suspect their account has been compromised. The User agrees to choose a secure password for their account and keep it confidential.

The Operator may restrict, suspend or close the User’s account on the Website if it reasonably believes that the User has violated any of these terms.

10. Content

Nothing in these terms gives the Operator ownership of the intellectual property that the User shares with the Website, such as their personal data or other personal posts.

The Operator cannot be held liable for content submitted by the User. The User is solely responsible for the content they submit to the Website.

Prohibited content and Moderation

The User acknowledges that the Website is a community, non-commercial platform. Accordingly, it is strictly prohibited to post any content (whether a topic, reply, profile data or introduction) that:

Constitutes prohibited advertising or commercial promotion under applicable Hungarian legislation (with particular regard to the promotion of e-cigarettes, refill liquids and tobacco products).
Serves to directly or indirectly promote commercial entities, physical stores or webshops (whether domestic or foreign) (e.g. publishing opening hours, contact details, price lists or purchase-encouraging text).
Promotes illegal sources of procurement.

The Operator reserves the right to delete or modify content that violates the above points at their own discretion and without prior notice, and to restrict or permanently suspend the account of the offending user.

The prohibition does not apply to natural experience sharing between private individuals, provided it does not take on an advertising character and does not show systematic commercial interest.

Permitted: If a user mentions where they purchased a device in the context of a professional question, or shares a link to a product for the purpose of seeking an opinion.
Prohibited: If a user (or business profile) repeatedly links to a specific store in a promotional manner, or uses their profile/posts to promote a business (e.g. publishing opening hours, promotional advertisements, business contact details).

The Operator reserves the right to decide on a case-by-case basis whether given content constitutes community experience sharing or prohibited advertising activity.

Content deletion

In the case of topics

The User acknowledges and accepts that as long as no reply has been received on a topic, they have the option to retract or delete it. After retraction, the content of the topic will be replaced by (the author deleted this topic) and after 24 hours the topic will also be removed. During this time the author has the option to restore the topic. Users can also view the topic history of a retracted but still visible topic.

In the case of posts

The author does not need to provide a reason for deleting a post! They can do so at any time, but a notice (the author deleted this post) will remain visible to other users for 24 hours, during which time they can view the retracted post in the history. During this time the author also has the option to restore their post, should they change their mind about the deletion.

11. Copyright

The content on the Website, including texts, images, videos and audio recordings, is protected by copyright. This means that use of the content without the author’s permission is prohibited. The Users defined in Roles, namely Administrators, Moderators and Category Moderators, have the right to modify or rearrange user posts and content for moderation purposes for the benefit of the community. Your permission is not required for this, and you should expect this to occur from time to time. Please be aware of this when publishing on the Website.

The following uses are permitted on the Website:

Viewing and reading content within the Website.
Quoting, sharing or copying content within the Website with proper attribution.

The following uses are prohibited on the Website:

Commercial use of content without the author’s permission.
Misappropriation of copyright-protected content.

In the event of copyright infringement, the author may seek legal remedy through the courts. Remedies may include damages, injunctions against the infringing conduct, and removal of the infringing content.

The Operator encourages respect for copyright. Users are obliged to comply with copyright laws.

12. Electronic cigarette - Posting ads in the Buy & Sell category

Unacceptable advertisements, including the Prohibited advertisements section in Other, non-e-cig - Posting ads in the Marketplace category…

The Advertiser acknowledges and accepts that it is strictly PROHIBITED to include base liquid and its components in any form in their uploaded advertisement, and it is also PROHIBITED to advertise unsealed products. Furthermore, it is PROHIBITED to advertise any disposable electronic cigarette, single-use or heated tobacco product. Any advertisement that violates this rule will be immediately rejected and deleted without warning!

Furthermore, the advertisement may not contain information related to payment (bank transfer, other online payment methods) or shipping. The advertisement may only include the option of personal pickup.

The Advertiser acknowledges and accepts that the Operator has the right to edit or modify the advertisement if it violates any point of these Terms of Service! (example: deleting or modifying parts of the advertisement text related to liquids or base liquids intended for sale or as a gift)

Advertisement type:

The User ensures that they select the appropriate advertisement type for their listing. The Operator reserves the right to correct the advertisement type if the User has selected an incorrect one, or to refuse to allow the advertisement to appear on the Website.

Advertisement description:

The User acknowledges and accepts that the advertisement description is a longer introductory text in which, in addition to precisely defining the product to be advertised, all aspects relating to the condition of the product must be considered and any potential defects or damage must be noted. The advertisement text may not contain offensive words or expressions.

Images:

The User acknowledges and accepts that uploaded files may not display images or graphics falling into the following categories (brutality, sexuality, politics, totalitarian symbols, unidentifiable or non-functional QR or bar codes). The Operator reserves the right to refuse to allow the advertisement to continue appearing if any images or graphics falling into the above categories are found attached to the User’s advertisement. In extreme cases, the User may also be banned!

The User acknowledges and accepts that uploaded images may only be their own photos of the advertised product. (This rule does not apply to the “Looking for” advertisement type.)

The Operator reserves the right to verify the above criteria at multiple levels and to refuse to approve the advertisement if non-compliant images are uploaded.

Advertisement category:

The User ensures that they place their advertisement in the appropriate #buy-and-sell category created for this purpose, selecting the appropriate subcategory. The User acknowledges and accepts that if an incorrect category is selected, the Operator has the right to modify it and move the advertisement to the appropriate category.

Advertisement renewal and bumping:

The User acknowledges and accepts that advertisements have an expiry date.

Advertisements automatically close 30 days after the last reply. Replies posted under the advertisement restart the 30-day period, effectively renewing the advertisement. Once closed or marked as sold by the Advertiser, it will be deleted. It is of course possible to re-upload the advertisement after this.

The User acknowledges and accepts that replies posted under their advertisement may be deleted if they are related to bumping or renewal.

The User acknowledges and accepts that comments specifically intended to bump their advertisement may be made once per week, taking moral norms into account. If this is exceeded, the Operator has the right to delete the comment and revert the advertisement to its pre-bump position.

13. Other, non-e-cig - Posting ads in the Marketplace category

Advertisement description:

Images:

The User acknowledges and accepts that uploaded images may only be their own photos of the advertised product. (This rule does not apply to the “Looking for” advertisement type.)

The Operator reserves the right to verify the above criteria at multiple levels and to refuse to approve the advertisement if non-compliant images are uploaded.

Advertisement category:

The User ensures that they place their advertisement in the appropriate #off-topic:marketplace category created for this purpose, selecting the appropriate subcategory. The User acknowledges and accepts that if an incorrect category is selected, the Operator has the right to modify it and move the advertisement to the appropriate category.

Advertisement renewal and bumping:

The User acknowledges and accepts that advertisements have an expiry date.

The User acknowledges and accepts that replies posted under their advertisement may be deleted if they are related to bumping or renewal.

Prohibited items:

Weapons and ammunition: All types of weapons, ammunition, explosives and explosive components are prohibited. This includes gas weapons, airsoft guns, alarm pistols, bows, arrows, swords, knives and other weapons.
Drugs and prohibited substances: All types of drugs, prohibited substances and psychoactive materials are prohibited. This includes marijuana, cocaine, heroin, methamphetamine, LSD, mushrooms and other drugs.
Products containing hate speech: Any product that promotes hate speech, violence or discrimination is prohibited. This includes racist, sexist, homophobic and other hate speech-containing products.
Stolen goods: Any stolen, criminally obtained or illegally distributed product.
Dangerous products: Any product that may pose a danger to people or the environment is prohibited. This includes toxic substances, hazardous waste, explosives and other dangerous materials.
Gambling and betting: All forms of gambling and betting are prohibited. This includes lottery, casino games, sports betting and other forms of gambling.
Medical products: All types of medical products, medicines and medical devices are prohibited. This includes prescription drugs, over-the-counter medicines, surgical instruments and other medical products.
Illegal activities: Products related to any form of illegal activity are prohibited. This includes money laundering, terrorism, arms trafficking and other illegal activities.

Any advertisement that violates this rule will be immediately rejected and deleted without warning!

The Advertiser acknowledges and accepts that the Operator has the right to edit or modify the advertisement if it violates any point of these Terms of Service!

14. Dispute resolution

The User may first contact the Operator directly regarding any problem or dispute at team@vaperina.com. The Operator will provide a substantive response within 15 calendar days beginning the day after the complaint is received, unless the complexity of the complaint or extraordinary circumstances justify a longer procedure (in which case the Operator will notify the complainant without delay).

If the dispute cannot be resolved between the User and the Operator, the user is entitled to use the European Union’s Online Dispute Resolution Platform (ODR), available at the following link: EU ODR platform

The User agrees that the Operator may act freely on the basis of the feedback and suggestions provided by them.
